Introduction

GLOBAL POOL SYSTEMS PTE. LTD., operating under the brand PowerShift (“PowerShift”, “we”, “our”, or “us”), provides technology services and messaging communications to users and clients. By accessing or using our services, platform, or messaging features, you agree to comply with and be bound by the following Terms and Conditions.

PowerShift Messaging

By opting in, you agree to receive SMS messages from PowerShift, a service operated by GLOBAL POOL SYSTEMS PTE. LTD., related to appointment confirmations, appointment reminders, service updates, and account notifications.

You can cancel the SMS service at any time. Text STOP to unsubscribe. After you send STOP, you will receive a confirmation message, and you will no longer receive SMS messages from us unless you opt in again.

Carriers are not liable for delayed or undelivered messages.

Message and data rates may apply. Message frequency varies. For questions about your text or data plan, contact your wireless provider.

Service Description

PowerShift provides a technology platform offering business growth services such as website development, marketing support, automation systems, scheduling tools, and other digital services designed to help businesses operate and grow more efficiently.

Responsibility for Content

Clients are responsible for the content and information they provide to PowerShift, including any sensitive or proprietary information. We reserve the right to remove or modify any content that is illegal, harmful, offensive, or violates applicable laws or these Terms and Conditions.

Platform Operational Responsibilities

PowerShift is committed to providing reliable services and support to our clients. Support requests submitted through our designated communication channels are typically responded to within 24 hours. While we aim to resolve issues as quickly as possible, resolution times may vary depending on the complexity of the request. Our support team works to ensure a smooth and productive experience using our platform and services.

Confidentiality

PowerShift is committed to protecting the confidentiality of client information. We will only use client information for the purpose of delivering and improving our services and will not disclose it to third parties without prior consent unless required to do so by law or necessary to provide the service.

Payment Terms

Clients must pay for services according to the payment schedule agreed upon at the time of purchase or contract. Late payments may result in additional fees, suspension of services, or termination of access to the platform.

Billing and Payments

Purchases are due and payable in full upon billing. Charges must be paid in full notwithstanding requests for verification of items. Delinquent accounts may be subject to interest charges, late fees, suspension, or termination of services without notice.

All charges will be deemed final and binding unless disputed in writing within sixty (60) days of the billing date.

You agree to abide by the rules and regulations governing electronic payment processing systems used to complete transactions under this Agreement. You agree to maintain sufficient funds in your designated payment account to cover all charges associated with the services.

You agree to indemnify and hold PowerShift harmless from claims arising from circumstances beyond our control, including but not limited to technical failures, banking system issues, service interruptions, or actions of third-party financial institutions.

Billing Disputes

If you believe you have been billed incorrectly, you must notify PowerShift within sixty (60) days of the billing date. Refunds or adjustments will not be issued for disputes submitted after this period.

Clients may withhold payment of the disputed portion of a bill while the issue is under review, but all undisputed charges must still be paid by the due date. Once the dispute investigation is complete, any remaining balance must be paid within fifteen (15) days.

Discounts and Promotions

Unless otherwise specified, any discount, promotion, or special offer applies only during the initial service period. Discounts may not apply if the contract period expires, services are modified, or the agreement is renewed.

PowerShift reserves the right to modify or discontinue promotions at any time without prior notice.

Limitation of Liability

PowerShift shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services, including loss of revenue, profits, or data.

Clients agree to indemnify and hold harmless PowerShift, its employees, affiliates, and partners from any claims arising from misuse of the services or violation of these Terms.

Dispute Resolution

Any disputes arising from these Terms and Conditions shall be resolved through arbitration or other mutually agreed dispute resolution procedures.

Governing Law

These Terms and Conditions are governed by and interpreted according to the applicable laws governing GLOBAL POOL SYSTEMS PTE. LTD. and the jurisdiction in which the company is legally registered, unless otherwise required by applicable law.

Age Restriction (18+)

PowerShift services, including SMS communications, are intended only for individuals who are eighteen (18) years of age or older. We do not knowingly collect personal information from individuals under the age of 18. By using our services or opting in to receive SMS communications, you confirm that you are at least 18 years old.

Changes to Terms and Conditions

PowerShift reserves the right to modify these Terms and Conditions at any time. Users and clients will be notified of material changes through the website or email communication. Continued use of the services after changes have been implemented constitutes acceptance of the updated Terms.

By using our services or platform, you agree to be bound by these Terms and Conditions.
